被collect company追债了

As I work at collection department of a major credit card company (top 5), I
dont agree above opinions.
Here is a summary if you are too busy to read all this long post:
1. If already charge off, there is no big difference between paying and no
paying them at all since the damage to your credit score already happened
and will affect you in 7 years. If you still want pay them, you could pay
much less to settle down the case by negotiating with them. Based on
industry standard, you could pay 10% to 75% of your principle and completely
waived all fees and interest charge.Even you pay full amount without
negotiation, there is NO incremental benefit.
2. If not charge off yet, it is common to negotiate with the agency to pay
less than you original owe and get the case settle. The bottom line is only
pay full principle and waive all interest and penalty fee. Even you pay full
amount without negotiation, there is NO incremental benefit.
3. It is the same you pay the agency or your original creditor. Either of
them has legal liability to update your payment to all three major credit
bureaus.
4. No government will be involved at all unless your creditor will sue you.
Then it will become a legal action but due to higher cost to do that, your
company usually wont choose that option unless you owe them alot. Also they
will mail you that legal notice so you will know.So personally I believe
there is no impact to green card.
5. Talk to HR about this to see whether it is their mistakes. It is common
as well.
More info here:
These days due to current crisis and recession, volume of delinquent accts
grow bigger and bigger , it is very common that your original creditor sold
your amount to a collection agency at discounted rate, for example you owe
them $1000 and collection agency may buy it at price of $500, given the low
success rate. OR the agency may just work for the original creditor like
outsourced department.
Either way, if you pay them off, your case should be closed and the agency/
original creditor has legal liability to report back to all credit bureaus.
But that doesnt means you are back to normal and the consequence will
depends on whether you pay them before charge off (6 months after your late)
Worst Scenario: Already charge off OR you plan to ignore them and it will
charge off later
Consequence: Your credit score will be smashed and this amount will show as
charge off in all three credit bureau for 7 years. After 7 years it will
permanently removed. In these 7 years your current credit cards with other
creditors may be closed by them since they all see your charge off behavior
and you may not be able to open new credit card or get an auto loan or a
mortgage, and basically you'll have trouble to borrow money from any major
finance company. So you will live on cash.
Again, government will NOT be involved at all unless your creditor will sue
you and it becomes a legal action.
But if you already charge off, then the difference between paying them and
not paying at all wont be very much. Because your charge off record already
become public and will exist for 7 years, paying off now wont take it off.
Best Scenario: You just 0-5 months behind the original due day
Action: Call the agency ASAP and negotiate a deal with them, like waive some
of the amount, Ask them to update all bureau and give you a written letter
once done so.
Consequence: your delinquent status will show on all bureau but since you
settle down before charge off, most of finance company will avoid you for a
short term (1-2 years). As long as you are good during that 1-2 years, your
credit score will back to what ever you're.
