重磅！本财年EB-1，EB-2再加14万个绿卡名额！

 

2月18日，USCIS发布了一则消息，鼓励符合条件的绿卡申请人，尽量选择EB-1或者EB-2类别，公告中表示2022财年官方给到EB-1和EB-2的绿卡名额异常的多！

2022财年可以用于EB-1和EB-2的绿卡数量大约是往年的两倍。这次多出的绿卡配额，来自于2021财年未使用的亲属移民绿卡配额，大约为14万份。

按照美国现在移民局的规定，每年移民限额为67.5万，其中亲属移民就占有大比例，留给职业移民的的名额只有14万。这14万名额里还包括了主申请人的配偶以及子女。

USCIS建议绿卡申请人在符合资格时考虑在EB-1或EB-2类别下申请，并鼓励尽可能“Transfer of underlying basis”。

“Transfer of underlying basis”是指USCIS可以将待处理的绿卡申请从一个优惠类别重新分类到另一个优惠类别的过程，例如从EB-3到EB-2。USCIS概述了EB-2与EB-3两个类别切换I-485“Transfer of underlying basis”的要求。

从EB-3转移到EB-2，必须满足以下标准：

● 申请人持I-485等待审理期间一直保持合法身份

● 申请人已经有一份已获批的EB-2类别I-140

● EB-2当前有可用的I-485排期名额

如果满足上述要求，申请人可以书面请求USCIS将其待处理的绿卡申请从EB-3转移到EB-2。如果切换的基础是基于经批准的EB-2 I-140，则该请求必须附有由提交EB-2 I-140的同一雇主签署的表格I-485 Supplement J。

重要的是，如果申请人只有前雇主批准的EB-2 I-140，他们可能没有资格获得切换。

EB-2申请者需要拥有硕士或硕士以上学历，或者本科＋5年工作经验；EB-3申请者需要拥有本科或本科以上学历。

由于申请人数众多，中国人和印度人的绿卡申请要等待数年。

过去，有些申请人将自己的申请从EB-2降级到EB-3，因为之前EB-3的排期进展更快。现在看来，很多人可能会选择升级回EB-2了。
